VA_INDIAN;240364What happened With Ruchika and her family after the fact, was very terrible, if we go by what is written on internet and in news, that how her brother was paraded, hand cuffed, put in jail, beaten, her father also harrassed in many ways, Ruchika expelled from school, and many more, after going so much what would a person have done, when Ruchika felt, that her whole family is being victim of the dirty system in India, including her father, brother, she may have decided to end her life, at times courts esp higher courts, can see through , even if abetment to suicide may not be the right charge, but something as serious can be applied to this Tharki and put him in jail

lets hope so and I am sure with so much attenton now focused, center too wanting to do something to save the image, and the new charges slapped as of yesterday, should be enough to deal with this DIG Mafia[/quote]
Based on what is in the press, Many serious charges can possibly be levelled (not abetment). However proving them is another matter. Most of the evidence will be hearsay.

What I wonder is why is it that the family does not sue the guy - does not India allow civil damages? Does Indian law not allow for a lower standard of proof of guilt (preponderance of evidence vs beyond reasonable doubt, where hearsay may be very well admissable) for civil damages?

I agree! Proving all the allegations will be a major hurdle. As Indians we are very emotional but that is a good thing as that is what is driving people to push this case for justice but the bad part of our emotional nature is the "josh". All this energy and frustration will disappear faster than a fart in a hurricane.
Let us see if we keep this thread active for another 10 days. I doubt!

Criminal cases which are considered more severe, take 20 years in this case, civil damages not sure if the outcome would ever come. I think for Ruchika's family criminal charges to be proven would win them peace.

Jaaniji, aradhana does not 'handle' ruchika's case, she was her best friend and witness to the molestation and took it upon as her life's mission for her friend's sake.
Truly a remarkable tale of perseverence, belief in one's conviction and courage to take on the rotten system.!

Rahtore gets 18 months rigorous imprisonment for molesting ruchika.:thup:
Some solace for the family harassed, destroyed and driven to lose a child to suicide, by the shameless top cop.
Hope CBI will be able to prove more serious charges like abetment to suicide (Would be extremely difficult if not impossible), of implicating her brother in false cases, of throwing her out of school, of sending goondas to harass the family to finally drive them out of their house. It is a tall order, but then Rathore deserves no less and more importantly it is going down as a land amrk case in judicial annals for more than one reason, and hopefully future molesters will think twice!:)

This is called a Class example of the " Fence eating the Crop " !

And, this delayed and joke-like punishment is even more ridiculous.

A lady spent 18+ years to stay behind the case, two lives been lost and all we hear is,...... 18 mos. jail !

But that's how our society and system is !

A sessions court today enhanced the jail term of Rathore from six months to one-and-a-half years for molesting a 14-year-old girl 20 years ago following which the former top policeman was arrested by the CBI.
Mr. Moily said the punishment would “drive fear” in the mind of the people that if they commit such a crime, they will meet the same fate.

Is he joking???

Only one and a half year , then in six months he would most likely be paroled for good behavior. And,.. Yesss. A class cell in jail.

I think Mr. Molly is dead mistaken on this. This will not drive any fear.
This will invite the scroundels to " Come, Join and have feast " !!

This is not a joke thread, but still,.. this is , how our Govt. / Police and whole society system is.

भारतीय पुलिस दो दिन तक लौट के नहीं आयी. तो सभी अधिकारी उनको ढूंढ़ने के लिए जंगल में घुस गए. घने जंगल में क्या देखते है कि,..............
भारतीय पुलिस एक गीदड़ को उल्टा लटका के मार रही थी और कह रही थी -

" कुबूल कर भैन के ***, की में ही शेर हूँ " That's the only arena, where our police force's strength lies in !

The maximum punishment for molestation per the Indian Penal Code, which is what he was charged with in this case is 2 years.

Is there a provision for increasing the sentence if the girl is under aged? Is any politician trying to amend the penal code after so much spot light on this issue?
