Non resident american - tax status

Hi,
I'm a US citizen and OCI. I have returned to India few years ago and I'm now a resident for Indian tax purposes. My dilemma is regarding the tax status in US. Am I to be considered as a resident and file 1040 or am I to be considered as a non-resident American? If I'm an NRA, which form should I file for income tax returns? I have no income in the US now and present in US less than 30 days.
As I was going through some IRS forms, I came to understand that if one is considered as a resident in a tax-treaty country, that person can be treated as a non-resident in US. So, what form should I file (1040NR)?
